HOSTING SERVICES

A web hosting service is a type of Internet service that offers individuals and organizations the opportunity to host their own web sites and store information, images, video, or other content accessible via the World Wide Web. A Storage Service Provider (SSP) is a company that provides computer storage space and related management services. SSPs also offer periodic backup and archiving.

We only offer web hosting services, not data storage services. This means you may not use your web hosting plan for storing your personal files / using it as a file storage service.

Terminology

The following terminology applies to our Terms of Service, Privacy Statement and Disclaimer Notice and all Agreements: "Client", "You" and "Your" refers to you, the person log on this website and compliant to the our terms of service. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves. "BusinessManaged", or "BusinessManaged.org" refers to our website or us. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provisioning our stated services. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to the same thing.

REFUND POLICY

You understand that BusinessManaged does not offer any refunds whatsoever, unless your service which you purchased from us is deemed to be non-functional. Non-functional means you cannot access your web hosting control panel for more than 168 hours.

CHARGEBACKS

Chargebacks are not considered as a way of refunding. Any customer who initiates a chargeback will have their services terminated and their billing account status set to 'Fraud', and will be forbidden from purchase services from us again. We really do not appreciate chargebacks. If you initiate a chargeback, you may be required to pay a $100.00 fee to BusinessManaged via PayPal, which is to be decided by BusinessManaged.

ACCOUNT SUSPENSION & TERMINATION

When your web hosting invoice is overdue by 1 day, the associated web hosting service/account will be suspended, meaning it will be inaccessible until the associated invoice/bill is paid. If the invoice has not been paid and is 7 days overdue, the associated web hosting account/website will be terminated, meaning all data will be removed and cannot be restored. If you are having trouble paying and are worried about your service getting suspended or terminated, feel free to open a support ticket in your account, and we may be able to sort out a manual payment via PayPal.

YOU ARE RESPONSIBLE

You are responsible for all of your actions. You may not hold us liable under any circumstances for any loss or damage of/to your web hosting account, including but not limited to; account information, website, databases, emails, files, DNS Settings, Hosting Account, Website, or email accounts.

- Hacker programs or archives
- Warez sites
- IRC scripts, eggdrops, bots, Bitcoin faucets
- Proxy server scripts (also any other script which operates as proxy)
- Mail bomber and spam scripts
- IP spoofers and port scanners
- Pirated Software or any form of warez
- Image Hosting Scripts (like imgur or Photobucket)
- AutoSurf site scripts
- PPC site scripts
- PTC site scripts
- Crypto sites
- Bruteforce Programs or scripts
- File sharing, dump and mirroring service scripts (like mega, rapidshare)
- File storage websites, scripts or similar (like NextCloud)
- Top sites generator scripts
- Illegal drug or any other substance or product not allowed to be sold in the UK & USA or Contraband related sites
- Sites distributing copyrighted content without proper licenses
- Movie streaming sites
- Gambling sites
- Hacker programs, credit card dumps, hacker focused sites
- Phishing sites or activities
- Forums distributing warez or any other illegal content
- Fraudulent sites (fake banking services, fake login pages, any other site mining information in illegal ways)
- Malware, viruses, trojan horses, mass ping, ddos, udp or tcp flood scripts, or other kind of desctructive scripts
- Child pornography or pornography of any type

We do not allow domains/subdomains with 'paypal' or any other services names, for example 'sony', 'google' and etc.

We reserve the right to terminate, suspend, cancel, delete/remove, or block any account instantly without notice and for any reason.

File Quotas & Traffic Quotas:

  1. Files/Inode Quota - On some of our hosting packages, we do not limit the amount of disk space you can have in your account, although we do limit your account Inodes. An Inode can be thought of as a file and/or folder. For example, if your account has 10,000 Inodes, it means you have 10,000 of both files and folders total.
  2. Disk Space & Traffic - The 'unlimited disk space' web hosting plans offers generous amounts of disk space and network bandwidth. Customers must not allow other websites or hosting servers to link to files stored in their hosting accounts, and thus steal network traffic. In order to escape unjust distribution of the resources, as well as possible sharing of illegal content, Customers are not allowed to use their hosting accounts as a remote storage server only or solely for the purpose of sharing (un)archived images, programs or sound files. At least 80% of all files and/or total megabytes used (including MP3, WAV, RA, GIF, JPG, ZIP, RAR, but not limited to these file types) in each hosting account must be a part of actual, active website(s) content, i.e. all content files must have corresponding HTML or PHP files that link to them. Audio, graphics and/or video files must be must be under 25% of the current web hosting disk usage and must never exceed 50 GB in size. Furthermore, such media files may amount to no more than 50% of the customer's total monthly traffic usage. You may be within these limits, but BusinessManaged still reserves the right to terminate, remove, delete, suspend, or block your account without notice and for any reason.
  3. MySQL usage - each database hosted in our system can be used only by the user who created it. Another user, whose account is hosted on the same or on another server, cannot use the database created in the first-mentioned customer account. The MySQL database has a limit of 45,000 queries per hour. If you have reached 45,000 queries per a given hour, you will not be able to make any more queries. In the next hour you will have access to the database again and the counter will be reset. You can make a maximum of 15 simultaneous connections to a MySQL database.
  4. Access and error logs - The access and error logs for all client's hosts in one account should not exceed 500 MB in total.

Additionally, you understand that both our Yearly Managed and Monthly Managed plans/packages have a hard disk space limit of 10GB. This means you can only host up to 10GB of data on your website, and that after you exceed the 10GB hard limit, we may no longer be able to serve your website to visitors. This usually means your web hosting account would be suspended. You can contact us to have the suspension removed. Our Enterprise Managed plan does not have a disk space limit, customers have no set disk space limit, on our Enterprise Managed plan.

No unlawful or prohibited use:

Customers are solely responsible for the content of their messages and website(s). Using our hosting services in connection with surveys, contests, pyramid schemes, chain letters, junk e-mail, spamming or any duplicative or unsolicited messages (commercial or other) is prohibited.

In this light, we expressly forbid any breach of Federal, State or Local regulation, including, but not limited to, the transmission of: copyrighted material, material legally judged to be threatening or obscene, and material protected by trade secrets. Our web hosting CANNOT be used for the propagation, distribution, housing, processing, storing, or handling in any way of lewd, obscene, adult or pornographic material. Customers may not attempt to gain unauthorized access to any of our Services, other accounts, computer systems or networks connected to any of our Services, through hacking, password mining or other means. Customers may not obtain or attempt to obtain any materials or information through any means not intentionally made available by our Services.

You also agree, that you will not use the Services in a manner that:

We reserve the right to refuse service to unlawful parties. We reserve the right at all times to disclose any information, as we deem necessary, to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in the sole discretion of us.

TERMINATION WITHOUT NOTICE

You agree that we, at our sole discretion, may terminate your password, account or use of the Service(or any part thereof), and remove and discard any Content within the Service if you violate these terms of service, or for any reason. We also reserve the right to refuse your order for any reason, with or without a reimbursement.

INCORRECT WEBSITE CONTENT

Content on our website may be outdated or incorrect. You should never rely on content on our homepage (businessmanaged.org).
